« Brother Paul O'Donnell on Hannity & Colmes (VIDEO) | Main | Minus the mourned, family and friends remember Terri Schiavo » April 6, 2005Shiavo case Redux in Georgia: Mae Magouirk...not comatose, not vegetative, not terminal, BEING STARVED AND DEHYDRATED TO DEATH (Update)Topics: Press ReleasesRECEIVED VIA EMAIL - EMERGENCY UPDATE 1(noticed question in comments about authentication): This was confirmed by lengthy telephone call before it was posted. I personally spoke with Kenneth Mullinax, and have more details than has been posted. We do need to seek copies of court documents for posting From: The Family of Mae Magouirk Contact: Kenneth Mullinax Ph: 205-408-7598 Why is Hospice LaGrange, Ga. withholding nourishment? Mae Magouirk is being withheld nourishment and fluids and the Provisions of her Living Will are not being honored at the Hospice-LaGrange, (1510 Vernon Street, LaGrange "Troup County" Georgia, (706-845-3905) a subsidiary of the LaGrange Hospital in LaGrange Georgia. Her family is desperately seeking to save her life before she dies of malnourishment and dehydration. Mae Magouirk IS NOT comatose and she IS NOT vegetative. She is not terminal! Despite these facts the Hospice and Beth Gaddy (706-882-9124), a school teacher at LaGrange's Calloway Middle School and granddaughter of Mae Magouirk(who according to "heresay," may have been mismanaging funds of the 85 yr-old woman) have been denying her proactive nourishment or fluids (via a nose administered feeding tube or fluids via an IV) since March 28 without prior legal consent; against the wishes of her Living Will and against the wishes of Mae Magouirk's closest living next of kin. Mae Magouirk's next of kin are: Mr. A. B. McLeod (Her Brother 256-236-1331) and Mrs. Lonnie Ruth Mullinax (Her sister 205-408-7598) both of nearby Anniston, Alabama. Under Georgia law, unless a medical durable power of attorney is in place, your closest living next of kin are stipulated to make all medical decisions. When Mae Magouirk's closest living next of kin lodged a complaint with Hospice LaGrange's in-house attorney Carol Todd (706-882-1411) last Thursday, March 31, Ms. Todd checked Mae Magouirk's case file and upon examination of both documents discovered that Beth Gaddy DID NOT have the durable medical power of attorney for Mae Magouirk and upon closer examination of Mae Magouirk's Living Will ascertained that fluids and nourishment were ONLY TO BE WITHHELD if she was either comatose or vegetative. SHE IS IN NEITHER STATE!!! Nor is Mae Magouirk terminally ill. Her local LaGrange, Ga. cardiologist, Dr. James Brennan (706-812-4308) and Dr. Raed Aqel, (205-934-9999) a highly acclaimed interventional cardiologist at the nationally renowned University of Alabama-Birmingham Medical Center have determined that Mae Magouirk's aortic dissection is contained and not presently life threatening. Two weeks ago, Mae Magouirk's aorta had a dissection and she was hospitalized in the LaGrange Hospital in LaGrange, Ga. Her aortic problem was at first determined to be severe and she was admitted in the intensive care Unit. Her granddaughter, Beth Gaddy, a teacher at the Calloway Middle School in LaGrange, stated that she held Mae Magouirk's medical power of attorney and thus invoked said powers against the wishes of Mae Magouirk's closest living next of kin by having her moved to Hospice-LaGrange. While at Hospice-LaGrange, Beth Gaddy stated that her wishes were for no nourishment for Mae Magouirk v Probate Judge Donald Boyd (706) 883-1690)... Attorney for saving Mae's life: Jack Kirby, Kirby & Roberts, (706) 884-2992*** Update 2: But that's behind us, and we are a larger group now and growing, we've gained some experience and contacts, we've learned a little more about how to work together and are getting better organized, and we are learning how to divide up our labors and act quickly. Let's try to avoid letting our hearts overtake us, let's use them because they are a great asset, but we have to outsmart and outwork the euthanasia crowd, and let's not forget that. We are likely to have many people like Terri that need our help, so let's move forward methodically and with determination to stay the course, together. One last thing: We know how hateful and angry our opposition can be, but let's not fall into the trap of getting angry ourselves - let's keep our cool, be an example for others to follow, and by all means pray hard and fight hard. Update 3: Random and Politically Incorect Thoughts also verified. Posted by richard at April 6, 2005 9:46 PM Articles Related to Press Releases:

I am so emotionally exhausted myself. We have to do something to help or Terri's death was in vein. Posted by: Julie at April 6, 2005 10:17 PM What has to happen to get the feeding commenced again. If the woman did not have the power of medical attorney then the people who are responsible for Mae should be able to ensure that this is immediately stopped. The attorneys, by contacting blogs for Terri have alerted us to this situation for a reason. A careful reading of the alert indicates that behind the attempt to kill Mae in this way, there is the issue of fraud. This is a common thread with the controversial cases. What we need to do is get the word out about Mae's case and ensure that her feeding is recommenced ASAP. Posted by: Maggie4life at April 6, 2005 10:27 PM Has anyone at BlogsForTerri validated this? Is it true? I am ready to post it on my site but I am leery to do so until I know a bit more. Posted by: Tom Spence at April 6, 2005 10:54 PM Aortic dissection is a condition in which there is bleeding into and along the wall of the aorta (the major artery from the heart). This condition may also involve abnormal widening or ballooning of the aorta. Aortic dissection occurs in approximately 2 out of every 10,000 people. It can affect anyone, but is most often seen in men aged 40 to 70. Surgical repair or replacement of the section of aorta is curative in some cases. If the aortic valve is compromised by the dissection, aortic valve replacement is necessary. If the coronary (heart) arteries are involved, a coronary bypass is also performed. Aortic dissection is life-threatening. The likelihood of death within the first 48 hours is 1% per hour for untreated patients. The disorder is curable with surgical repair if it is performed before aortic rupture. Less than half of patients with ruptured aorta survive. Posted by: that woman at April 6, 2005 11:11 PM I am also weary- but I will do ALL I CAN! I have already written my Representatives (I live right here in GA) and an attorney friend of mine with political pull. I called the Law office also. They are not too far from me. one Area COde over. No way I am going to sit back and watch this happen again! They are counting on people being sick of the story.... gauranteed! Posted by: Straight Up with Sherri at April 7, 2005 12:28 AM Once again I am confused-can she speak? Can she tell them what she wants? That is the first thing I need to know. Posted by: alwayschooselife at April 7, 2005 1:36 AM I have emailed Governor Perdue via his website: http://www.gov.state.ga.us/contact_intl.shtml There is no mention in this article of a judge approving the starvation? Perhaps it will be easier for the DFS to get in there this time, if we harrass somebody like Sonny Perdue. The awful thing is that a tiny part of me is waiting for someone to say this is all just an evil hoax, but maybe thats just wishful thinking. Posted by: Cheryl at April 7, 2005 1:47 AM Someone needs to confirm Bath Gaddy's phone number listed above. They are claiming it is a wrong number. Not that I take that denial at face value. Posted by: Baldwin at April 7, 2005 5:17 AM And so it starts....first Terri, then Mae, then someone else until society accepts it as the norm. Where the "bleep" is the Congress while these judges are making the laws??? Posted by: Tress at April 7, 2005 6:35 AM Michael Brown has posted the link to the Random and Politically Incorrect Thoughts on his website.... www.spiritdaily.com Has anyone been able to find any press articles on this story??? Posted by: Tress at April 7, 2005 8:07 AM Ok, I just got off the phone with Mae's nephew Kenneth Mullinax. He was very kind and gracious. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Baldwin, he verified Beth Gaddy's phone number and gave me her cell number 706-668-0590. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ This is a very real situation. This woman suffers from the same thing that killed John Ritter, the actor. (See Webmd.com for details http://my.webmd.com/content/article/73/88944.htm ) It is a very managable disease with the right treatment. In fact, according to Kenneth, his mom has the same disease and was in the kitchen cooking when I called him. You can contact him at mockingbird@compuhel.net ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Archbishop Wliton Gregory of Atlanta is not sure if he should get involved because the woman is not Catholic. The issue I have that is that her religious preference should not matter. You can email him at archbishop@archatl.com or his pro-life director Mary Boyert at mboyert@bellsouth.net. Please call, email do whatever you can. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Kenneth said he is now trying to contact the media...if you have any connections, now is the time to use them!!! Posted by: Pam_T at April 7, 2005 9:42 AM I just called the attorney's office and spoke with the secretary about this case. (YES, TO THOSE OF YOU WHO NEED FURTHER CONFIRMATION IT IS REALLY HAPPENING). Jack Kirby is the attorney handling the case. He was on another line so I left him a message asking him to call me and give me directives on how we (the Terrisfight team) can best be of assistance. If he returns my call, I'll post what he told me. Posted by: Anna_Nordin at April 7, 2005 10:04 AM Of course I'll help, and of course I've already posted on my blog, but I do have a couple of questions: 1. Considering that the in-house attorney for the hospice determined that the granddaughter does not in fact hold the durable power of attorney, and also that Mae's Living Will stipulates that fluids and nourishment are only to be withheld in the case of a coma or vegetative state, what's the problem? If the patient is aware and competent, why does she not order sustenance for herself? 2. Why does the real holder of the durable Power of Attorney not show up down there with a sheriff and the proper legal document in hand to ensure that Mae is being cared for properly? Have they contacted the local news stations? Seems to me that the hospice has opened itself to (to use a polite term) deep Dutch for this. I just want to understand so that I have all my ducks in a row when the trolls and detractors start coming a-calling. Thanks in advance, Posted by: Linda at April 7, 2005 1:38 PM We need someone within driving distance to go get us contact info of the local law enforcement and district attorney. Let's hope they aren't as corrupt as they were in Pinellas county because we only have several days before she is dead. Posted by: Baldwin at April 7, 2005 5:56 PM ...and the hotline for the DCFS in Georgia. Posted by: Baldwin at April 7, 2005 6:04 PM Our big problem is that a scofflaw judge has given the granddaughter guardianship so it is going to be very hard to reverse this in time. It looks good until you find out the hospice-LaGrange facility director is president of a group that is trying to change the culture regarding death and has ties to Hospice for the Florida Sun Coast, yeah that group, George Felos' group, the group that controlled Terri's Woodside hospice. The one headed up by the founder of the successor organization to the 'euthanasia society of america'. If this judge is a pro-euthanasia judge he just recommends a majority of pro-euthanasia doctors, the family are new to this and don't know any better, and the verdict still comes out death. Posted by: Baldwin at April 7, 2005 10:08 PM Hey Baldwin I said on of the other posts higher up that we need someone to step up as the leader of this gang-organize-assign-divide and conquer-I think you could be the one for that job-you have done great at getting a ton of info- Posted by: alwayschooselife at April 7, 2005 11:30 PM |

I am exhausted!
If she and her family have an attorney, they need to file criminal complaints of fraud (forged power of medical attorney) and attempted murder in CRIMINAL court. To hell with this f&*^*^%ing around with civil probate courts.
Sorry for the language. I love the Schindlers, but I am having doubts that they or their lawyers were/are MEAN enough. The best defense is a good offense. Hit'em hard. Hit'em early. Get MEAN. Put people in JAIL.
Key word -- early.
